A judge dismissed a manslaughter charge against Daniel Penny, who fatally choked Jordan Neely, leaving jurors to consider a criminally negligent homicide charge.

Jurors resumed deliberations Wednesday and asked to review police and bystander video at the heart of the chokehold manslaughter case against Daniel Penny as well as to hear a readback of testimony.

Deliberations are continuing Wednesday in the trial of Daniel Penny, charged in the chokehold death of Jordan Neely on the subway last year.Deliberations began Tuesday afternoon. Between Tuesday and Wednesday afternoon,
